Law Unclear in Massachusetts On Whether Schools On Hook for Sexual Misconduct By Employees

March 12, 2019

Statutes and case law in Massachusetts make it unclear whether a school is civilly liable for an employee who engages in sexual misconduct, a former state Supreme Judicial Court justice said.

John Greaney, who recently retired from the court, predicted that the state’s highest court would accept a case that would give the court a chance to clarify if schools are on the hook in Massachusetts for such behavior, according to MassLive.com.

“It’s an open question in Massachusetts,” said Greaney, who now works as a lawyer again and who recently co-authored a law review article on the subject, according to MassLive.com.
