Haitian Illegal Migrant Charged With Rape In Peabody Handed Over To ICE

A Haitian illegal immigrant accused of raping a pregnant woman has been detained by federal immigration authorities.

Marc Kervens Beauvais, 34, was arrested on Tuesday, August 13. He has been charged with “aggravated rape, two counts of assault and battery with a dangerous weapon on a pregnant victim, and attempt to commit a crime,” according to a press release from Enforcement and Removal Operations Boston, a division of U.S. Immigration and Customs Enforcement.

“Marc Kervens Beauvais is charged with committing unspeakable acts against a pregnant woman in Massachusetts,” said Todd Lyons, Boston field office director of Enforcement and Removal Operations, in the written statement. “We simply can not allow anyone that poses such a threat to prey upon the residents of our communities. ERO Boston will continue our mission of prioritizing public safety by aggressively apprehending and removing egregious noncitizen offenders from New England.”

Former President Donald Trump’s campaign blamed the alleged rape on weak border policy from the Biden-Harris administration.

“Kamala Harris is directly responsible for the rapes, murders, and assaults of innocent women perpetrated by illegal aliens who are in our country because of her open border policy,” Trump campaign press secretary Karoline Leavitt said in a written statement that mentions this incident, plus several similar ones nationwide. “We must stop this epidemic of migrant crime in its tracks. The only way we do that is by electing President Donald Trump.”

United States Border Patrol arrested Beauvais on June 26, 2021, after he entered the United States illegally near Del Rio, Texas. Border Patrol then issued Beauvais a notice to report for processing and released him.

Peabody police arrested Beauvais three week ago, on July 31. Federal immigration authorities lodged an immigration detainer against Beauvais with the Peabody Police Department later that day.

Peabody District Court arraigned Beauvais on those charges on August 1.

Peabody District Court honored the immigration detainer. The court released Beauvais into the custody of Enforcement and Removal Operations Boston on August 13; he was still in federal custody as of this past weekend.

Federal immigration authorities also apprehended a 35-year-old Brazilian illegal immigrant last week who is charged with rape in Wakefield.

Jackson Bento-Pinheiro, charged with assault to rape, indecent assault and battery over 14, and domestic assault and battery, was handed over to immigration authorities on August 13, according to a press release from Enforcement and Removal Operations Boston.

U.S. Border Patrol arrested Bento on July 10, 2021, after he illegally entered the United States near San Ysidro, California. One day later, Border Patrol officials issued Bento a notice to appear before a U.S. Department of Justice immigration judge and released him under the Alternatives to Detention program.

Bento reported to Enforcement and Removal Operations Boston on August 22, 2021. A court terminated him from the Alternatives To Detention program one day later. However, he didn’t leave the country.

Wakefield police arrested Bento on August 13 on the rape charge. Federal immigration authorities issued an immigration detainer against Bento that same day — and the Wakefield police handed him over. He was still in federal custody as of this past weekend.
