Guatemalan Child Rapist Illegal Immigrant Charged With Unlawful Re-Entry Into United States
July 1, 2024
A Guatemalan illegal immigrant who is also a child rapist pleaded guilty in federal court in Boston last week to unlawful re-entry into the United States.
Wilson Hernandez-Bautista, 34, pled guilty to one count of unlawful re-entry of a deported alien, according to a press release from the U.S. Attorney for the District of Massachusetts.
U.S. District Court Judge Nathaniel M. Gorton scheduled sentencing for October 3, 2024. A federal grand jury indicted Hernandez-Bautista in December 2023.
Hernandez-Bautista was first deported from the United States on October 9, 2013. He then re-entered the country illegally at an unknown time and was convicted of rape of child with force in Essex County Superior Court in November 2014. During a five-to-seven-year prison sentence for Hernandez-Bautista, U.S. Immigrations and Customs Enforcement became aware that the man was an illegal immigrant.
Unlawful re-entry of a deported alien carries a sentence of up to two years in prison, one year of supervised release, and a fine of up to $250,000.
“Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case,” the press release said.
