Nantucket Town Meeting Approves Bylaw Allowing Women To Go Topless At Beaches

May 4, 2022

A proposal that two allow women to go topless at Nantucket’s town beaches passed at Town Meeting on Tuesday night.

The measure passed 327-242 on Tuesday, May 3, but it won’t go into effect immediately.

The warrant article will now go to Massachusetts Attorney General Maura Healey’s office for review. That’s because all town bylaws need approval from the state Attormey General’s office in order to take effect.

In addition, Massachusetts law generally makes it illegal for women to be topless in public.

Exposure of female breasts in certain circumstances constitutes Open and Gross Lewdness and Lascivious Behavior in the Commonwealth of Massachusetts, according to Chapter 272 Section 16 of the Massachusetts General Laws; it carries a prison sentence of up to three years.

The Attorney General’s office has 90 days to review the measure.
